QBP Scanner — Terms of Use
These Terms govern your use of the QBP Scanner application for iOS. Please read them before using the app. If you do not agree with them, do not use the app.
These Terms and Apple's
QBP Scanner is distributed through the Apple App Store. Apple's Licensed Application End User License Agreement (the “Standard EULA”) is the baseline agreement for your use of the app, and it applies in full.
These Terms are additional to the Standard EULA, not a replacement for it. They set out the terms specific to this app. Where these Terms and the Standard EULA cover the same subject and cannot both be satisfied, the Standard EULA prevails to the extent of the conflict.
These Terms are an agreement between you and Murat Kuşlu (İzmir, Türkiye), the developer and publisher of the app. Apple is not a party to them. Apple has no obligation to furnish maintenance or support for the app, and, as set out in the Standard EULA, Apple is not responsible for addressing any claim you may have relating to the app.
By downloading or using the app, you accept these Terms.
Licence
You are granted a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices that you own or control, on the terms and within the scope permitted by the Standard EULA and the App Store Terms of Service.
The app, its source code, its design and its name remain the property of the operator. Nothing in these Terms transfers ownership of any intellectual property to you. You may not copy, sell, sublicense, rent or redistribute the app, and you may not reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits despite this restriction.
The content you create with the app — your scans, your documents and your PDFs — is yours. We claim no rights over it and, as described in the Privacy Policy, never receive it.
Acceptable use
You agree to use the app lawfully. In particular, you agree not to:
- use the app to scan, decode, copy or process material you have no right to scan, decode, copy or process;
- use the app to infringe anyone's intellectual property, privacy or other rights;
- use the app to gain unauthorised access to any system, or to probe, scan or test the security of any system or network without authorisation, including by way of the link-check or webhook features;
- configure a webhook endpoint you are not entitled to send data to, or send data to any endpoint in breach of any law or of any duty of confidentiality you owe;
- use the app in any way that overloads, disrupts or abuses a third-party service the app relies on, including the Open Food Facts database;
- use the app for any unlawful, fraudulent or harmful purpose, or in breach of any applicable export control or sanctions law;
- interfere with, disable or circumvent any security, subscription or licensing mechanism in the app.
You are solely responsible for what you scan, for what you do with the results, and for compliance with the laws that apply to you.
Subscriptions and billing
The app's optional paid tier, QBP Pro, is an auto-renewing subscription available on a weekly or a yearly plan. Each plan includes a free introductory trial (currently three days) where you are eligible; the exact price, period and trial are shown to you on the purchase screen before you confirm, and those displayed terms govern.
- Billing. Payment is charged to your Apple ID account at confirmation of purchase. All billing is performed by Apple; we do not process payments and never see your payment details.
- Renewal. The subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Free trial. If you buy a subscription while a free trial is running, the unused part of the trial is forfeited, as required by Apple.
- Managing and cancelling. You manage and cancel your subscription yourself, on your device, under Settings › [your name] › Subscriptions. Deleting the app does not cancel a subscription.
- Refunds. Refunds for App Store purchases are handled solely by Apple, through reportaproblem.apple.com, under Apple's policies. We are not able to grant, deny or process refunds.
- Restoring. Use “Restore Purchases” in the app's Settings while signed in with the Apple ID that made the purchase.
- Price changes. Prices may change; any change will be applied in accordance with Apple's rules, which require notice and, in the relevant cases, your consent before a renewal at a new price.
Your own endpoints and data
The app lets you configure a webhook URL of your own. If you do, the contents of your scans are sent to that address. That endpoint is yours: you choose it, you operate it or arrange for it to be operated, and you are entirely responsible for it — for its security, for its availability, for what happens to the data once it arrives, and for having the right to send that data there. We have no visibility of and no responsibility for that endpoint or that traffic.
Similarly, you are responsible for keeping your own copies of anything you care about. The app stores your data on your device and, if you enable it, in your own iCloud. Where you have used the app's on-device encryption, a lost password cannot be recovered by anyone, including us, and the encrypted content will be permanently inaccessible.
Third-party information
Some of what the app displays comes from outside it. Product information for retail barcodes is supplied by Open Food Facts, an independent open database that is not operated by us and whose entries are contributed and maintained by that project and its community. We are grateful for their work, and we do not verify, endorse or guarantee it.
The link safety check reports where a scanned URL resolves by following its redirect chain. It is an advisory signal, not a security guarantee: it is not a malware scan, it cannot judge the content or intent of a destination, and a link it resolves successfully may still be harmful. The decision to open any link is yours.
No warranty
The app is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, to the fullest extent permitted by applicable law. This includes, without limitation, any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
In particular, and without limiting the above, we do not warrant the accuracy, completeness or reliability of scan results, decoded payloads, recognised (OCR) text, product information, or link safety verdicts. Code reading and text recognition can misread, and third-party data can be wrong or out of date. Do not rely on the app alone where an error would matter — verify anything important against its source, and do not use the app as the sole basis for a decision with medical, financial, legal, safety or dietary consequences.
We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or version of iOS.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted, and you may have rights that these Terms cannot limit — including, for consumers in the European Union, the United Kingdom and Türkiye, mandatory statutory rights that remain unaffected.
Limitation of liability
To the fullest extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, loss of profits, or loss of business, arising out of or in connection with your use of or inability to use the app — including any loss arising from an inaccurate scan result, an incorrect product lookup, a link safety verdict, a webhook delivery, or the loss of an encryption password.
To the fullest extent permitted by applicable law, the operator's total aggregate liability arising out of or in connection with the app shall not exceed the greater of the amount you actually paid for the app or its subscriptions in the twelve months preceding the event giving rise to the claim, or ten euros (EUR 10).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for wilful misconduct or gross negligence. Consumers' mandatory statutory rights are not affected.
Privacy
How the app handles information is described in the QBP Scanner Privacy Policy, which forms part of these Terms. In summary: there is no account, no analytics, no advertising and no tracking; scanning happens on your device; and the only data that leaves it does so through the optional and clearly-described features set out in that policy.
Availability and changes
The app is developed and maintained by an individual. We may change, add or remove features, and we may suspend or discontinue the app or any part of it, at any time. Where a change is significant we will note it in the release notes. Features that depend on third-party services may stop working if those services change or become unavailable, and that is outside our control.
Termination
These Terms apply for as long as you use the app. You may end them at any time by deleting the app (subject to cancelling any subscription separately, as described in section 4). Your licence terminates automatically if you materially breach these Terms. Sections 6 to 8 and 12 survive termination.
Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law rules, and the courts and enforcement offices of İzmir, Türkiye shall have jurisdiction over any dispute arising from them.
If you are a consumer resident in the European Union, the United Kingdom, or elsewhere, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may also be entitled to bring proceedings in the courts of that country.
If any provision of these Terms is held unenforceable, the remaining provisions continue in full force.
Changes to these Terms
These Terms may be updated. When they are, the effective date at the top of this page is changed, and that update is how changes are announced. Continuing to use the app after the effective date of a revised version means you accept it. The current version is always the one published at this address.
